General terms and conditions

The conditions below apply to all assignments given to EVD Advocaten.

Applicability

These general terms and conditions apply to all assignments provided to EVD Advocaten and to all work performed by or on behalf of EVD Advocaten.

Assignment

An engagement agreement is established after EVD Advocaten has accepted the assignment. EVD Advocaten determines which lawyer or legal assistant will perform the work. If necessary, work may be performed by multiple employees.

Services

EVD Advocaten makes every effort to execute each assignment carefully, expertly, and to the best of its insight. However, no guarantee is given regarding a specific result.

Client Obligations

The client shall provide all relevant information and documents necessary for the execution of the assignment in a timely manner. EVD Advocaten may rely on the accuracy and completeness of the information provided.

Fees and Costs

The previously agreed hourly rate, fixed price, or other price agreement applies to the work. In addition to the fee, disbursements, court fees, bailiff costs, and other external costs may be charged separately. All amounts are exclusive of VAT, unless stated otherwise.

Payment

Invoices must be paid within 14 days of the invoice date, unless otherwise agreed in writing. In the event of late payment, the client shall owe statutory interest and any collection costs.

Confidentiality

EVD Advocaten treats all information received in the context of the services as confidential and acts in accordance with applicable laws and regulations and the rules of conduct applicable to lawyers.

Liability

Any liability of EVD Advocaten is limited to the amount paid out in the relevant case under the professional liability insurance, increased by the amount of any deductible. If, for any reason, no payout occurs, liability is limited to the amount of the fee paid for the assignment in question.

Retention period

Files are kept for the legally required period. Thereafter, files may be destroyed, unless legal obligations or special circumstances require otherwise.

Complaints

If a client has a complaint about the services, they are requested to make this known in writing as soon as possible. EVD Advocaten will handle the complaint carefully in accordance with the internal complaints procedure.

Applicable Law

All agreements and legal relationships with EVD Advocaten are governed exclusively by Dutch law. Disputes shall be submitted to the competent Dutch court.
